1. Acceptance
By using this website, requesting a quote, or purchasing materials from Dubois Topsoil & Aggregates("we," "us"), you agree to these terms. If you don't agree, please don't use the site or place an order.
2. Quotes & Pricing
All prices on this website and in any online estimate are estimates only. Final pricing — including delivery fees, mileage, fuel surcharges, and any applicable taxes — is confirmed when we book the load. Pricing is subject to change without notice based on material costs, fuel costs, and demand.
Quotes are valid for 30 days unless otherwise stated.
3. Materials
We sell aggregate materials (loam, topsoil, stone, gravel, sand, fill, mulch, and related products) by the cubic yard, ton, or load as specified. Material color, gradation, and composition are natural products and may vary between loads. We make a best effort to deliver consistent material but cannot guarantee exact match between separate orders.
You are responsible for confirming that the material you order is appropriate for your project. We are happy to advise — call us before you order if you're not sure.
4. Delivery
- On a full 20 yd³ load within 5 miles of our Lyman pit, the load price is the delivered price — no additional mileage fee. Smaller loads carry a per-yard surcharge. Mileage charges of $4.00 per loaded mile apply beyond 5 miles.
- Delivery has a 10 cubic yard minimum.
- Delivery times are estimates. Weather, equipment, and earlier jobs may shift our schedule. We'll keep you informed.
- Site access is your responsibility. You must ensure the drop site is accessible to a loaded dump truck (clear overhead, suitable surface, adequate turning radius, no posted road or weight restrictions). If our driver determines the site is unsafe or inaccessible, we may decline to deliver. A trip charge may apply.
- Damage:We're not liable for damage to driveways, lawns, irrigation, septic systems, drain tile, buried utilities, or other property along the delivery route or at the drop site. If you have concerns, mark the route or limit access and we'll work around it.
- Once material is dumped, it's yours. We do not relocate or re-load delivered material without an additional charge.
5. Pickup at the Pit
Customers picking up at our Lyman pit are responsible for the condition and capacity of their vehicle and trailer. We'll load to your stated capacity but won't exceed posted vehicle weight ratings. Customers assume all risk for travel from the pit.
6. Payment
Payment is due on delivery or at pickup unless prior credit arrangements have been made. We accept cash, check, and most major credit cards. Returned checks are subject to a fee.
7. No Warranty
Our materials are sold "as is." We make no warranty, express or implied, of merchantability or fitness for a particular purpose. We specifically disclaim liability for landscape, lawn, drainage, or structural outcomes.
8. Limitation of Liability
To the maximum extent allowed by law, our total liability for any claim related to materials sold or services provided is limited to the amount you paid for the specific order in question. We are not liable for indirect, incidental, or consequential damages.
9. Returns & Refunds
Bulk aggregate, loam, mulch, and sand are non-returnable once delivered or picked up. If we deliver the wrong material, contact us within 24 hours and we'll make it right.
10. Website Use
The content on this website (text, photos, layout) is owned by Dubois Topsoil & Aggregatesor its licensors. Don't copy, mirror, or republish material from this site without written permission.
11. Governing Law
These terms are governed by the laws of the State of Maine. Any dispute will be brought in the state or federal courts located in York County, Maine.
12. Changes
We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision.
